Action 2: Evidence assembly
Your lawyer gathers everything needed to build the claim: medical records and specialist reports, witness statements, employer incident reports (for workplace injuries), police crash reports (for motor vehicle accidents), CCTV footage requests, insurer correspondence, and any other documentation specific to your case. How long does a workers compensation claim take in WA?
It depends on the severity of your injuries. The insurer has 14 days to decide on your claim after your employer submits it. But a full settlement often requires waiting for your injuries to stabilise, which can take 12 months or more for serious injuries. Soul Legal manages the timeline and keeps you informed at each stage.
What if my employer’s insurer rejects my workers comp claim?
You have the right to challenge the decision through WorkCover WA’s Conciliation and Arbitration Services. This is where having a lawyer with experience in the WA conciliation process matters. Soul Legal handles the dispute on your behalf.
Can I claim workers comp even if the accident was partly my fault?
