Medical Negligence Or A Poor Outcome In WA: How To Tell The Difference
Written By: Rebecca Sorgiovanni Reviewed By: Kevin Wong, Director and Personal Injury Lawyer Last Reviewed: 7 September 2026 A bad result is not the same
Soul Legal was founded in 2018 by two lawyers who had already spent decades doing this work. Between them, Kevin Wong and Rebecca Sorgiovanni have carried personal injury claims from a first phone call all the way to the High Court of Australia. When you call about a Thornlie injury, one of them takes your file. You will not be passed to a graduate for the parts that decide your payout.
Kevin Wong has practised personal injury law since 1991, the year he graduated from UWA Law School. He was instructing solicitor in De Sales v Ingrilli [2002] HCA 52, the High Court case that abolished the old discount widows faced for the “chance of remarriage” in dependency claims. He was counsel at first instance and co-counsel on appeal in Westrupp v BIS Industries Limited [2015] FCAFC 173, which established workers compensation coverage for FIFO workers. He has appeared in WorkCover, the District Court, the Supreme Court of Western Australia, the Federal Court and the High Court. That is a level of courtroom record you will not find at a general suburban practice.
Rebecca Sorgiovanni has practised since 1997 and built her reputation representing injured workers, including as the recommended lawyer for a local government workers union. She founded her own firm, Sorgiovanni Legal, in 2007, then co-founded Soul Legal with Kevin in 2018. She is an accredited alternative dispute resolution practitioner, which matters because most claims settle at the negotiating table rather than in a courtroom. Workers compensation is where she does much of her work, and it is the claim type Thornlie sees most.
The firm is named for the client, not the founders. Soul Legal was recommended in the 2017 Doyles Guide and both directors are members of the Australian Lawyers Alliance.

Were you injured in a public place due to unsafe conditions or a faulty product? You may be entitled to pursue a personal injury claim. Compensation can help cover medical expenses, lost income and other costs arising from your injury.
If you have been injured at work or while travelling between job sites, you may be eligible to make a workers’ compensation claim. Compensation may assist with medical treatment, lost wages and other injury-related expenses.
Have you been injured in a car, truck, motorcycle, bicycle or quad bike accident? You may be eligible to claim compensation for your injuries and losses. Your entitlement will depend on the circumstances of the accident and who was at fault.

Soul Legal runs every category of WA compensation claim. The common ones for Claremont come from the road, the workplace, and public spaces, and each runs on a different system with a different clock.

Thornlie sits next door to one of Perth’s biggest warehousing and distribution corridors. Canning Vale runs on forklifts, pallet racking, cold stores and long shifts, and that work produces crush injuries, back and shoulder damage, and repetitive strain. If you have been hurt at work, WA runs a no-fault scheme: you do not have to prove your employer did anything wrong to receive weekly income payments, medical expenses and rehabilitation. Soul Legal lodges your claim with WorkCover WA, fights rejected claims, and where a serious injury was caused by your employer’s negligence, pursues a common law claim on top through the District Court. See our workers compensation service.

Driver, passenger, rider, cyclist or pedestrian, you may be able to claim compensation after a crash. Motor vehicle injury claims in WA go through the Insurance Commission of Western Australia (ICWA) under the compulsory third party scheme, not directly against the other driver, and you can claim even if you were partly at fault. Soul Legal runs the whole ICWA process for you: treatment costs, rehabilitation, lost wages, and pain and suffering. See our car accident service.

An injury caused by unsafe conditions on someone else’s property may entitle you to compensation. Slip and fall, trip hazards, poorly kept premises and falling objects are the usual causes. Soul Legal helps Thornlie residents hold negligent owners and occupiers to account under the Civil Liability Act 2002 (WA). See our public liability service.

Victims of assault, sexual abuse and other crimes may claim through the Criminal Injuries Compensation Scheme, including for historical abuse. Kevin Wong has represented crime victims through the District Court for decades and handles these matters with the care they need.
The single most important thing to understand before you settle a WorkCover claim in 2026 is one most injured workers are never told. In 2025 the ATO issued Class Ruling CR 2025/88, covering settlements under WA’s Workers Compensation and Injury Management Act 2023. It draws a hard line through your settlement.
The income-replacement portion, the money that stands in for the wages you would have earned, is now assessable as ordinary income. You declare it, and it is taxed, in the single financial year you receive it. The rest of a typical settlement is treated differently: medical and health expenses, rehabilitation expenses, and permanent impairment compensation are generally not taxed as income.
Why this matters for a Thornlie worker: if you redeem years of weekly payments into one lump sum, that income portion can land in one tax year and push you into a higher bracket. A worker on an ordinary wage can face a tax bill they never saw coming. WorkCover WA has published guidance confirming the treatment, and through early 2026 some insurers grew so unsure about it that settlements slowed while the dust settled.
A lawyer who knows the ruling structures the agreement around it: negotiating the income component on a gross basis so tax and the Medicare levy are accounted for, and making sure the non-taxable heads of compensation are clearly identified in the deed. Get that wrong and the difference is real money. This is general information, not personal tax advice, and your own position depends on your circumstances, so confirm it with your lawyer and accountant before you sign anything. You can read the ruling itself at the ATO’s Class Ruling CR 2025/88.
The Workers Compensation and Injury Management Act 2023 started on 1 July 2024, and the first two years have been bumpy in ways that can affect your outcome.
The change most people never hear about sits in the second edition of WorkCover WA’s permanent impairment guidelines. Assessors are now told not to take the prospect of future surgery into account when they carry out a whole person impairment assessment. That reverses the position the Supreme Court had confirmed in East Metropolitan Health Service v Lee [2022] WASC 54. It is technical, but the effect is not: leaving future surgery out can lower your impairment percentage, and in WA you generally need a 15% whole person impairment to elect a common law claim for pain and suffering. A few percentage points can decide whether that door is open to you at all. If your treatment is still ongoing, the timing of your assessment is now a strategic decision, not a formality.
There was also a processing problem. Settlement approvals that used to take two or three weeks blew out to many weeks, and in some cases months, after the new Act commenced. The Law Society raised it, and the Minister acknowledged the backlog in April 2025 and said processing had returned to normal. If you were told your claim was “just waiting on approval” during that window, this is likely why.
Across the scheme, WorkCover WA recorded 29,304 claims in 2024/25 and paid out $1.645 billion. The return-to-work rate was 73.9% at three months. Those are the current operating conditions you are walking into if you are injured in Thornlie, and they are the reason having someone who tracks the changes is worth more now than it was three years ago.
Real local knowledge comes down to specific roads. Here is one that matters. The intersection of Garden Street and Nicholson Road, on the Thornlie and Canning Vale boundary, was voted the fifth-riskiest metropolitan intersection in the RAC’s 2025 Risky Roads survey, out of more than 18,000 nominations, the most the survey has ever received. Drivers described a confusing layout with little chance to turn or cross traffic safely.
This is not just a survey result. Main Roads WA is building a grade-separated overpass over that roundabout, part of the Nicholson Road, Garden Street and Yale Road project, specifically to improve safety and cut delays. Early works began in late 2024, with utility relocations continuing through 2026. If you drive Nicholson Road, Garden Street, Yale Road or Spencer Road on a Thornlie commute, you are using an intersection the state has formally flagged as a problem. A crash there is exactly the kind of ICWA claim Soul Legal runs.
The other side of local injury in Thornlie is work. The suburb sits inside the City of Gosnells, and the neighbouring Canning Vale industrial area is one of the largest freight, warehousing and manufacturing zones in the southern metro. Manual handling, loading docks and machinery are where the WorkCover claims come from. Knowing the kind of work Thornlie does is what lets us anticipate the injuries, the insurers and the arguments before they arrive. *At Soul Legal we only charge fees in personal injury claims if you are successful settling your claim or have a successful judgment (excluding disbursements). A Defendant may be able to claim costs against you if successful in defending an action brought by you
Not every injury needs a firm like this. If your injury was minor, you have fully recovered, and your only claim is a small, undisputed WorkCover medical expense, you may not need a lawyer at all, and paying for one would be poor value. WorkCover WA and its InjuryConnect service can walk you through a simple claim for free.
Where Soul Legal earns its keep is the harder end: serious and permanent injuries, rejected or disputed claims, common law negligence, catastrophic injury, and any settlement large enough that the CR 2025/88 tax question changes the number. If that is your situation, the free first consultation costs you nothing and tells you which category you are in. We would rather tell you honestly that you do not need us than take a file that a phone call to WorkCover would have solved.
The firm follows the same five stages on every claim, and manages all contact with insurers and opposing parties for you. Most claims settle by negotiation, without a court hearing.
Call (08) 6558 1786 or send an enquiry. A senior lawyer reviews your situation, looks at any documents you have, and gives you a straight assessment of whether you have a claim worth running. Free, confidential, no obligation. If you cannot travel from Thornlie, the firm comes to you.
Your lawyer gathers the evidence: medical records, specialist reports, witness statements, scene documentation, and material from insurers or employers. The firm carries this load, not you.
Your claim is lodged with the right body, ICWA for a motor vehicle accident, WorkCover WA for a workplace injury, or the relevant court for a negligence claim, inside every deadline and to spec.
Soul Legal negotiates directly with insurers. Kevin and Rebecca do not accept low offers, and many claims resolve at a pre-trial conference. For a WorkCover settlement, this is where the tax structure gets built into the deal, not bolted on afterward.
Once a fair outcome is reached, you are paid. If an insurer refuses a reasonable offer, the firm is ready to run the case to trial. Kevin Wong has taken matters to the Supreme Court and the High Court, which is the kind of backstop that keeps insurers honest during negotiation.
WA law gives you more than one route to compensation, depending on how and where you were hurt. The main statutes behind a Thornlie claim are the Limitation Act 2005 (WA), the Motor Vehicle (Third Party Insurance) Act 1943, the Workers Compensation and Injury Management Act 2023, and the Civil Liability Act 2002. Getting the right claim lodged in the right place, on time, is half the job.
Under the Limitation Act 2005 (WA), you generally have three years from when you first became aware of your injury to start court proceedings. For children under 15, that extends to six years. For a motor vehicle accident, you are expected to lodge the online crash report and the Notice of Intention to Make a Claim with ICWA within six months of the crash. A late notice is not automatically fatal, because ICWA has to show it was prejudiced to defeat your claim, but do not rely on that. Miss the main deadline and the claim can be gone for good.
Every WA motor injury claim runs through the Insurance Commission of Western Australia, funded by the CTP premium built into your registration, not against the other driver personally. Even in a hit-and-run where the driver is never identified, you may still be able to claim.
You do not have to prove your employer was negligent to receive weekly payments, medical cover and rehabilitation. You just have to show the injury happened in the course of your work. But if your employer’s negligence caused a serious injury, assessed at 15% whole person impairment or more, you can also pursue a common law claim for pain and suffering through the District Court. This is exactly where the new impairment-assessment rule can decide your eligibility.
Insurers employ experienced claims managers whose job is to keep payouts down. A lawyer who knows how insurers work puts you on even terms. Soul Legal makes sure no entitlement is left off the table and no deadline is missed.
Soul Legal acts for injured people across Thornlie and the surrounding City of Gosnells suburbs, including Canning Vale, Huntingdale, Southern River, Gosnells, Maddington, Langford, Kenwick and Beckenham. The Perth CBD office at Suite 2/22 St Georges Terrace and the Baldivis office are both reachable from Thornlie, and home visits are available if you cannot travel. The firm also acts across the neighbouring corridor, including as a personal injury lawyer in Armadale.
Soul Legal has run Western Australian injury claims since 1991. A typical claim runs No Win No Fee, with a free first consultation and the first ICWA or WorkCover notices lodged within the statutory deadlines. Two factors shape Thornlie claims in particular: the Garden Street and Nicholson Road corridor, ranked the fifth-riskiest metro intersection by the RAC in 2025, and the Canning Vale warehousing and freight sector that drives local workplace injuries. Call (08) 6558 1786 for an obligation-free assessment. Soul Legal is based in the Perth CBD, a short drive from Thornlie, and serves the wider Gosnells area.
Soul Legal is Leading Personal Injury Compensation Law Firm

Part of it can be. Under ATO Class Ruling CR 2025/88, the income-replacement portion of a WA workers compensation settlement is taxed as ordinary income in the year you receive it. Medical, rehabilitation and permanent impairment components are generally not taxed. Because a lump sum can push you into a higher bracket, the settlement should be structured with the tax in mind. This is general information, not personal tax advice, so confirm your position with your lawyer and accountant.
Nothing up front. Soul Legal works No Win No Fee, so you pay legal fees only if your claim succeeds. When it does, the firm pursues party-and-party costs from the insurer, which covers most of your legal costs. Your first consultation is free.
No. Soul Legal offers home and hospital visits across Thornlie and the City of Gosnells for clients who cannot travel, and takes after-hours calls on 0411 896 133. Documents can also be reviewed in advance through an upload link before your first consultation.
It depends on the claim. Serious-injury claims are often held until your injuries stabilise, which can take a year or more, because settling too early can undervalue a permanent injury. Most claims resolve by negotiation rather than trial.
Most WA claims settle in 9 to 18 months. Serious-injury claims often wait until the injury stabilises before settling, which can take a year or more, and the 2026 permanent impairment rule now allows a special assessment at eighteen months if your condition has not settled by then. Motor and workers compensation claims run on different clocks, and your lawyer will map yours at the first meeting.
You generally have three years from becoming aware of your injury to start court proceedings under the Limitation Act 2005 (WA), and six years for children under 15. For a motor vehicle accident, lodge your crash report and Notice of Intention to Make a Claim with ICWA within six months. Speak to a lawyer early, because some deadlines are strict.
Not for a standard WorkCover claim. You can receive weekly payments, medical expenses and rehabilitation without any impairment threshold. The 15% whole person impairment figure applies if you want to elect a common law claim for pain and suffering against a negligent employer. A recent change to how impairment is assessed can affect whether you reach that threshold, which is worth getting advice on before your assessment.
