Medical Negligence Or A Poor Outcome In WA: How To Tell The Difference
Written By: Rebecca Sorgiovanni Reviewed By: Kevin Wong, Director and Personal Injury Lawyer Last Reviewed: 7 September 2026 A bad result is not the same
Three things changed for injured Western Australians between July 2024 and August 2026: part of a workers’ compensation settlement became taxable, the permanent impairment rules were rewritten, and the dollar caps that decide your payout were re-indexed. If the figures you have been quoted are more than a year old, they are already out of date. You want a firm whose directors have argued WA compensation law since 1991 and who track those changes the week they land.
Soul Legal is a personal injury and compensation practice, and that is the only law it does. Director Kevin Wong has represented injured Western Australians since 1991, from minor whiplash to multi-million dollar catastrophic disability awards. He has run matters through WorkCover, the District Court, the Administrative Appeals Tribunal, the Supreme Court of Western Australia, and the High Court of Australia. He was the instructing solicitor in De Sales v Ingrilli, the 2002 High Court case that abolished the old “chance of remarriage” discount for widows in dependency claims, and he acted in Westrupp v BIS Industries, the 2015 Federal Court appeal that confirmed workers’ compensation cover for FIFO workers. That is a level of courtroom record you will not find in a general suburban practice.
Director Rebecca Sorgiovanni has practised since 1997 and ran her own firm, Sorgiovanni Legal, before co-founding Soul Legal with Kevin in 2018. She built her reputation representing injured local government workers and has appeared everywhere from the WA Industrial Relations Commission to the Court of Appeal. Between them, Kevin and Rebecca carry more than 75 years of compensation experience, and one of them runs your file personally. You are not handed to a graduate for the parts that decide your outcome.
Soul Legal’s directors have run WA injury claims since 1991 and take South Perth cases on a No Win No Fee basis, with a free first consultation and no fee unless the claim succeeds. Most WA personal injury claims settle in 9 to 18 months without a court hearing. The firm works from its Perth CBD office at Suite 2/22 St Georges Terrace, minutes across the Narrows Bridge from South Perth, with a second office in Baldivis, and it arranges home and hospital visits for clients who cannot travel. This is where the real questions start. Four things shifted in the last two years, and each one changes the size or the tax treatment of your South Perth claim. Getting them right is what decides your payout.
For a long time people assumed injury compensation was tax-free. That is no longer the full picture. The ATO’s Class Ruling CR 2025/88 confirms that the income-compensation portion of a WorkCover WA settlement is assessable as ordinary income under section 6-5 of the tax law, because it stands in for lost wages. The ruling applies from 1 July 2024 to 30 June 2029. The other parts of a settlement stay tax-free: medical and health expenses, workplace rehabilitation, permanent impairment compensation, dust disease compensation, and miscellaneous expenses are all disregarded under the injury exemption in section 118-37, so you do not declare them.
Here is why that matters for a redemption. If you fold years of weekly payments into a single lump sum, the whole income portion can be taxed in the one financial year you receive it, which can push you into a higher bracket than if you had drawn that income year by year. The practical fix is to know the split before you sign, and to negotiate the income component on a gross basis so a tax bill does not eat into it later. A lawyer who structures the settlement with this ruling in mind protects money that would otherwise go straight to the ATO.
WorkCover WA replaced its impairment guidelines with a second edition that took effect on 1 July 2026, and the change is not cosmetic. Under section 1.65, you can now request a special assessment before your condition has fully stabilised, once at least 18 months have passed since the injury. That 18-month clock runs from the date you were injured, not the date you lodged, which lets some workers reach a permanent impairment figure and settle sooner than the old rules allowed.
The catch sits in the same section. The assessor has to rate you on how you present on the day of the examination. They are not permitted to factor in surgery you are still waiting on, recovery they expect, or deterioration they fear. So the timing of that assessment can move your percentage either way, and the percentage is what the whole permanent impairment payment is calculated from. Book it at the wrong point in your recovery and you can lock in a number that does not reflect where you end up. This is exactly the kind of timing decision you can get wrong if all you are told is to “get an assessment.”
Your compensation is bounded by figures WorkCover re-indexes every July, so the figure that matters is the one for your date of injury, not last year’s. For 2026/27, effective 1 July 2026, the General Maximum Amount, the overall cap on income compensation plus permanent impairment, is $284,448, up from $273,220 the year before. Medical and health expenses are capped at 60 percent of that figure, which is $170,669, and workplace rehabilitation sits just under $20,000. On the motor vehicle side, WA still applies a threshold to pain-and-suffering claims: for 2025/26 an award below $26,500 pays nothing, and general damages run to a ceiling above $500,000, both indexed each year.
| What it covers | 2026/27 figure | Notes |
|---|---|---|
| General Maximum Amount (income plus permanent impairment) | $284,448 | Up from $273,220 in 2025/26. Effective 1 July 2026. |
| Medical and health expenses | $170,669 | Set at 60% of the General Maximum Amount. |
| Workplace rehabilitation expenses | Just under $20,000 | Capped separately under the same schedule. |
| Motor vehicle pain and suffering (general damages) | $26,500 floor | Awards below the floor pay nothing; indexed each July. |
| Serious-injury common law threshold (work) | 15% whole person impairment | Gate to a common law claim on top of statutory benefits. |
Numbers indexed by WorkCover WA and the Insurance Commission of WA. Confirm the figure that applies to your claim, since it depends on your date of injury.
South Perth runs on delivery. The cafe strip along Angelo Street, the Mends Street precinct by the ferry and Perth Zoo, and the student population near Curtin all pull a steady flow of riders and drivers who were, until recently, outside the usual injury schemes. From 17 August 2026, a Fair Work Commission order requires every delivery platform operating in Australia to fund a “reasonable minimum level” of personal accident insurance for its workers, covering roughly 250,000 people in on-demand delivery. The order is enforceable, but the benefit level, the waiting period, and the policy structure were left undefined, and it is an interim measure while related rideshare and parcel cases run their course. If you are hurt riding or driving for a platform around South Perth, the classic ICWA and WorkCover pathways may not be your only option, and you may hold cover you do not know about. That is worth a call before you assume you have nothing.
Injured in a public place due to unsafe conditions or a faulty product? You may be entitled to make a personal injury claim. Compensation can assist with medical costs, lost income and other expenses resulting from your injury.
If you have been injured at work or while travelling between job sites, you may be eligible to lodge a workers’ compensation claim. Compensation may help cover medical treatment, lost wages and other injury-related costs.
Injured in a car, truck, motorcycle, bicycle or quad bike accident? You may be entitled to claim compensation for your injuries and losses. Eligibility will depend on the circumstances of the accident and who was at fault.

If you are hurt at work or develop a work-related illness, WA’s no-fault scheme entitles you to income payments, medical and rehabilitation expenses, and permanent impairment compensation, without proving your employer did anything wrong. The cover reaches full-time, part-time, casual, and some contractor arrangements. Soul Legal’s workers’ compensation lawyers lodge the claim with WorkCover WA, challenge rejected or underpaid claims, and where employer negligence caused a serious injury assessed at 15 percent whole person impairment or above, pursue an additional common law claim through the District Court for pain and suffering and future loss.

Whether you were a driver, passenger, cyclist, motorcyclist, e-scooter rider, or pedestrian, a WA road injury is claimed through the Insurance Commission of Western Australia under the compulsory third party scheme, not directly against the other driver. It applies even where you were partly at fault, and even in a hit-and-run where the driver is never identified. Soul Legal’s car accident compensation lawyers run the whole ICWA process, from the Notice of Intention through to settlement, for medical treatment, rehabilitation, lost income, and pain and suffering.

An injury caused by unsafe conditions on public or private property can give rise to a claim under the Civil Liability Act 2002 (WA). Slip and fall on a wet floor, a trip on a broken footpath, a fall from poorly maintained stairs, an injury from falling objects on a building site: these are the common examples. With the South Perth peninsula in a long apartment-construction cycle, hoardings, scaffolding, and part-finished sites are a live hazard for residents and passers-by, and occupiers owe a duty to keep people safe from them. If you are weighing a public liability claim in Perth, here is what you have to prove.

When a healthcare provider breaches its duty of care through a surgical error, a misdiagnosis, delayed treatment, or a medication mistake, the harm can be permanent. These are technical claims that turn on expert evidence, and Soul Legal has the medical-legal experience to run them. Personality takes a back seat here; what wins is the report from the right specialist and a lawyer who knows how to test the treatment against the accepted standard.

Victims of assault, sexual abuse, and other crimes can claim through WA’s Criminal Injuries Compensation Scheme, including many historical abuse matters. Kevin Wong has represented crime victims through the District Court and the criminal injuries process for decades. A claim here does not depend on the offender being convicted, or even identified.

Under the Dog Act 1976 (WA), an owner is strictly liable for injuries their dog causes, which means you do not have to prove the owner was careless, only that their dog caused the harm. Compensation is often met by the owner’s home and contents insurance. Dog injuries are common where people and animals share tight space, and the South Perth foreshore and its off-lead areas see plenty of both.
Kevin Wong or Rebecca Sorgiovanni handles your matter personally through the stages that decide it. Thousands of claims have passed through their hands, and neither hands the critical work to a paralegal.
You pay no legal fees unless your claim succeeds. On a win, the firm pursues party-and-party costs from the insurer, which covers the bulk of the legal bill. Your first consultation is free, confidential, and carries no obligation, and if Soul Legal cannot help you, you are not charged. The firm is also on the Legal Aid panel.
If your injury stops you travelling, Soul Legal comes to you, at home or in hospital, anywhere around South Perth and greater Perth. After-hours consultations are available on 0411 896 133. You should not have to fight traffic on the Kwinana Freeway just to get advice.
Kevin has taken matters to the High Court of Australia and the Federal Court; Rebecca has appeared through to the Court of Appeal. When an insurer knows your lawyer will actually run a trial rather than settle for the first offer, the offer improves. That is the point of hiring a litigator instead of a form-filler.
Soul Legal does personal injury and compensation, and nothing else. Every lawyer on the team lives in WA compensation legislation, insurer tactics, and the medical evidence that sets the value of a claim. A general practice that also does conveyancing and wills cannot match that depth.
*At Soul Legal we only charge fees in personal injury claims if you are successful settling your claim or have a successful judgment (excluding disbursements). A Defendant may be able to claim costs against you if successful in defending an action brought by you
Soul Legal runs a five-stage process for every claim, from the first free assessment to the final payment. Most matters settle through negotiation, and the firm handles every dealing with insurers and opposing parties so you can get on with recovering.
WA law gives you different pathways depending on how and where you were hurt. The main statutes behind a South Perth claim are the Limitation Act 2005 (WA), the Motor Vehicle (Third Party Insurance) Act 1943, the Workers’ Compensation and Injury Management Act 2023, and the Civil Liability Act 2002. Each sets its own clock and its own rules, and missing a step can cost you the claim.
Under the Limitation Act 2005 (WA) you generally have three years from when you first became aware of your injury to start court proceedings, and six years for a child under 15. For a motor vehicle claim, ICWA expects your crash report and Notice of Intention to Make a Claim within six months of the accident. A late notice is not automatically fatal, because ICWA has to show it was actually prejudiced to defeat the claim, but every month you wait makes the claim harder to prove.
All WA road injury claims go through the Insurance Commission of Western Australia, funded by the CTP premium in your rego. The numbers behind that scheme are under strain. ICWA recorded 3,941 new motor injury claims in 2024/25 and had 7,264 claims still open at 30 June 2025, up from 6,934 a year earlier, against a total motor injury liability of $3.65 billion. The state’s road toll reached 112 deaths in the first half of 2026, up from 103 over the same period in 2025, the worst pace WA has seen in a calendar year since 2008. Regional crashes account for about 16 percent of reported crashes but 32 percent of new catastrophic injury claims. A scheme working through that volume does not volunteer extra money, which is the reason to have someone reading it as closely as its own assessors do.
You do not have to prove your employer was negligent to draw workers’ compensation. Showing the injury happened in the course of your work is enough to open income payments, medical cover, and rehabilitation support. Negligence only becomes the question if you cross the 15 percent whole person impairment threshold and pursue a common law claim on top, for the pain and suffering and future loss the statutory scheme does not fully cover.
Insurers run experienced claims teams whose job is to close your file for as little as possible. That is not a scandal, it is their business model, and it is why the sides are uneven until you have your own lawyer. Soul Legal’s job is to make sure no entitlement is missed and no deadline is dropped
Soul Legal acts for injured residents across South Perth and the wider City of South Perth, including neighbouring Como, Kensington, Karawara, Manning, Salter Point, and Waterford, and reaches across the water to Applecross over the Canning and East Perth over the Swan. The Perth office at Suite 2/22 St Georges Terrace sits a few minutes across the Narrows, and home visits fill the gap for anyone who cannot make the trip.
South Perth is not a quiet dormitory suburb, and its injury profile shows it. The peninsula has been in a sustained high-rise construction cycle, with towers like Civic Heart on Mends Street and a run of apartment projects along Labouchere Road and Mill Point Road, which puts scaffolding, cranes, and part-built sites into daily life for workers and residents alike. The eastern edge of the suburb is the Kwinana Freeway, which reported crash data ranks as Perth’s highest-crash road, running from the Narrows interchange down to the Canning Bridge. The foreshore, Sir James Mitchell Park, the Mends Street jetty, and Perth Zoo draw heavy pedestrian, cyclist, and e-scooter traffic, especially on event days. And the hospitality strips on Angelo Street and around the ferry keep a constant stream of delivery riders on the road. Each of those settings produces a different kind of injury claim, and Soul Legal has run all of them.
Soul Legal is Leading Personal Injury Compensation Law Firm

Part of it can be. Following ATO Class Ruling CR 2025/88, the income-compensation portion of a WorkCover WA settlement is taxed as ordinary income in the year you receive it. The medical, rehabilitation, permanent impairment, and dust disease portions are not taxed. If you are redeeming weekly payments into a lump sum, get the split and the tax worked out before you sign, because the whole income part can land in one financial year.
Nothing up front, and nothing at all unless you win. Soul Legal runs personal injury claims on a No Win No Fee basis, and on a successful claim it recovers party-and-party costs from the insurer, which covers most of the bill. The first consultation is free. Disbursements are separate, and a defendant may seek costs if they successfully defend a claim you bring.
Timing matters more than it used to. Under the second-edition WorkCover guidelines from 1 July 2026, a special assessment can be requested once 18 months have passed since your injury, even if your condition has not stabilised, and the assessor must rate you on how you present on the day, without allowing for future surgery, recovery, or deterioration. Book it at the wrong point and you can lock in a percentage that undersells your injury. A lawyer helps you pick the moment.
Most settle in 9 to 18 months. A straightforward motor vehicle or workers’ compensation claim can move faster; a serious injury often waits until your condition stabilises, which can take a year or more, so the final figure reflects your real long-term needs.
Usually yes. WA motor vehicle claims run through ICWA on a scheme that allows recovery even where you were partly at fault, and even in a hit-and-run where the driver is never found. Your compensation may be reduced by your share of responsibility, but partial fault rarely ends a claim.
Possibly, and more so since 17 August 2026, when a Fair Work Commission order began requiring delivery platforms to fund personal accident insurance for their workers. The benefit levels are not yet defined, and platform cover sits oddly beside the ICWA and WorkCover schemes, so it is worth a call to work out which pathway pays for your injury.
Generally three years from when you became aware of the injury under the Limitation Act 2005 (WA), and six years for a child under 15. For a motor vehicle claim, ICWA expects notice within six months of the crash. Do not sit on it; evidence fades and deadlines are hard gates.
Probably not. Most WA personal injury claims settle by negotiation, often at a pre-trial conference. Soul Legal prepares every claim as though it could go to trial, which is what makes insurers offer properly, but the trial itself is the exception, not the rule.
