Where your workers compensation claim stands in Baldivis in 2026

If you’ve been hurt at work in Baldivis, your claim runs under the Workers’ Compensation and Injury Management Act 2023, and the scheme moved this year. On 9 April 2026, WorkCover WA released 2026/27 premium rates that rise an average of 5.9%, from 1.823% to 1.931% of wages, for policies renewing from 30 June 2026. The rise is uneven: some industry classes are up more than 20%, while parts of labour hire and clerical work are coming down. When premiums climb in an industry, insurers tend to look harder at the claims coming out of it. If you work in construction, roofing, road work, hospitality or an office role under pressure from psychological claims, that scrutiny can land on your file.

Soul Legal runs WorkCover WA workers compensation claims from a Baldivis office, on a no win, no fee basis. Director Kevin Wong has acted in personal injury law since 1991. Co-director Rebecca Sorgiovanni has specialised in it since 1997. Between them that’s more than 62 years of WA personal injury experience, and you work with a qualified solicitor directly, not a case manager.

What you’re really after when you search for the best workers compensation lawyer in Baldivis is someone who knows how WorkCover WA assesses claims, what medical evidence carries weight, and the deadlines that quietly end a claim if you miss them. That’s the work that follows.

The Workers Compensation Claims We Run in Baldivis

Soul Legal acts on physical and psychological workers compensation claims across Baldivis, Rockingham and the wider Peel region, under the WA state scheme and, for Commonwealth employees, the Comcare scheme.

State scheme claims under the 2023 Act

Most WA workers are covered by the state scheme. We act on workplace accidents, gradual-onset injuries from repetitive work, injuries during work activities, and psychological injuries including work-related stress, anxiety, depression and post-traumatic stress disorder. Psychological claims need medical evidence from a psychologist or psychiatrist linking the condition to your work, and they’re exactly the claims facing tighter insurer review in 2026.

We also act on noise-induced hearing loss, which is common in the industrial work around Baldivis and Kwinana. The scheme compensates binaural hearing loss above 10% (5% for a later claim), and you can request an audiological test every two years. There’s a 2026 change here that helps if your exposure was years ago, covered in the next section.

Comcare claims for Commonwealth employees

If you’re a Commonwealth employee, your claim runs under Comcare, not the state scheme, with different rules and a different review path. We can advise on Comcare matters and merits review.

Common law damages and the 15% threshold

Beyond statutory benefits, you may be able to claim common law damages, a separate lump sum for pain, suffering and loss of earning capacity. WA sets a clear gate. You generally need a whole-person impairment assessed at 15% or more, and you must register an election before court proceedings start. Under the 2023 Act, a writ can’t be issued and damages can’t be awarded or settled without that 15% assessment and a registered election. Electing or settling can close other doors, so get advice before you sign anything. The exact thresholds and timing for your situation depend on your injuries and your assessment, which is part of what we work out at the start.

What changed in 2026, and why it affects your claim

This is the part the standard “best lawyer” pages haven’t caught up on. Three current changes matter for a Baldivis claim.

The 2026/27 premium shift. WorkCover WA’s recommended rate rose to 1.931% of wages for 2026/27, up from 1.823%, for policies renewing from 4pm on 30 June 2026. The average hides big industry swings: several construction and service classes are up by double digits, some above 20%, while certain labour-hire and clerical classes fell. Higher cost pressure in your industry usually means an insurer that disputes more and approves slower. Knowing where your industry sits helps us anticipate where your claim is likely to be challenged.

The “noisy employer” rule for hearing loss. From 30 June 2026, the Workers Compensation and Injury Management Amendment Regulations 2026 clarify how WorkCover WA decides the “noisy employer” for a noise-induced hearing loss claim when you’ve already left that job. If your exposure was with a previous employer and you’ve since moved on (common in trades and industrial work around the Peel region), this affects who’s liable for your claim. The same amendments also bring fishing crew workers into the scheme from 30 June 2026, which matters for coastal work south of Perth.

What the 2023 Act already changed. The Act that took effect on 1 July 2024 improved several things worth knowing. Income compensation now holds at the higher rate longer, with the step-down extended from 13 to 26 weeks. The cap on medical and health expenses doubled. A Catastrophic Injuries Support Scheme now provides lifetime care for the most serious injuries. And employers must lodge your claim form and medical certificate within 7 days, so a stalling employer is on the wrong side of the rules, not you.

The Soul Legal 7-Point Claim Protection Checklist

What you do in the first week protects, or weakens, everything that follows. This is the checklist we run through with every new Baldivis client.

  1. Tell your doctor about every injury, at the first visit. What’s recorded early becomes the medical backbone of your claim. The most common mistake we see is workers trying to tough it out and recover without medical intervention, then struggling to prove the injury later.
  2. Get the connection to work written down. Ask your doctor to record that the condition is work-related. For psychological and hearing-loss claims especially, that link is the claim.
  3. Lodge the workers compensation claim form with your employer, in writing. Your employer must pass it to their insurer, and from 1 July 2024 they have 7 days to lodge it and the medical certificate.
  4. Don’t sign or settle anything before you understand it. A lump sum offer or a deed can look generous and still fall short of future treatment and lost earnings. With common law, signing an election or settling can be final.
  5. Keep your own paper trail. Payslips, incident reports, names of colleagues who saw it, every medical receipt. Evidence of financial loss is part of what you’re claiming.
  6. Watch the deadlines. Limitation periods can bar a claim entirely, and common law has its own 15% and election requirements. The safe move is advice early, not late.
  7. Get legal advice before you talk numbers with the insurer. Once you know the rules, your questions to the insurer get sharper and your claim gets stronger.

What your claim can include, and how no win, no fee works

What you may be able to claim. Under the WA scheme, a workers compensation claim can include income compensation to replace lost wages, medical and health expenses, rehabilitation costs, and permanent impairment compensation if your injury leaves lasting damage. Where the 15% threshold is met, common law damages for pain, suffering and loss of earning capacity may be available on top. What you actually receive depends on the injury, your losses and your earning capacity, which is why we give you a realistic picture once your condition has stabilised rather than a number on day one.

What no win, no fee means here. You pay no legal fees unless your claim succeeds. When it does, the majority of legal fees are usually recovered from the other side or their insurer. Any gap that can’t be recovered comes out of your settlement at the end, and we give you a costs estimate up front so there are no surprises. Separately, there are disbursements, the third-party costs of running a claim such as medical reports and specialist assessments. Soul Legal is on the Legal Aid Panel, so where a client can’t fund disbursements in a meritorious claim, Legal Aid usually covers them. That’s the financial barrier removed for people who’d otherwise go without help.

Our process, from first call to settlement

Before your first appointment, we send a secure upload link so you can submit your documents and we can review your case ahead of time. At that first meeting we gather the facts, explain your rights under WA law, set out the steps to protect your claim, and walk you through the no win, no fee retainer with a costs estimate.

A proper assessment of what you’re owed usually has to wait until your injuries have stabilised and your doctors can give a clear picture of the future. For serious injuries that can take a year, sometimes longer if surgery is ongoing or the prognosis is uncertain. In the meantime we collect the medical and financial evidence, draft the submissions, and put your full claim to the insurer. Our aim is to settle without court or WorkCover proceedings where we can. If the insurer won’t offer a fair result, we’re prepared to take it through the proper channels, whether that’s WorkCover proceedings or the District Court for a common law claim.

FAQ

Most frequent questions and answers

Yes, you can make a workers compensation claim for psychological injuries in Western Australia. Mental health conditions caused by your job, including work-related stress, anxiety, depression, and post-traumatic stress disorder, are covered under the Workers’ Compensation and Injury Management Act. You will need medical evidence from a qualified psychologist or psychiatrist that links your psychological condition to your workplace. It is important to report your injury and get treatment as soon as you can. Our team at Soul Legal’s Baldivis office has extensive experience with psychological injury claims and can guide you through the specific requirements and evidence needed to support your claim.

Workers compensation in WA can provide several types of benefits depending on your situation. These include weekly income payments to replace lost wages while you are unable to work, full coverage of all medical and rehabilitation costs related to your injury, permanent impairment compensation if your injury results in lasting damage assessed under the AMA guidelines, and in the right circumstances, common law damages for pain and suffering and loss of earning capacity. The specific entitlements you receive depend on the nature and severity of your workplace injury, your earning capacity, whether you can return to suitable work, and whether your claim falls under the state-based scheme or Comcare for Commonwealth employees. The best workers compensation lawyer Baldivis has available can look at your individual circumstances and give you realistic expectations about compensation.

Yes, strict time limits apply to workers compensation claims in Western Australia. You must let your employer know about your injury as soon as possible after it happens or after you become aware that your condition is related to your work. You should fill out and submit a workers compensation claim form promptly, ideally within days or weeks of your injury. Insurers must also be told about your intention to claim within a reasonable timeframe. There are limitation periods that can stop you from pursuing a claim altogether if deadlines are missed. Most importantly, for common law claims, a one-year time limit applies from the date your weekly payments stop. We strongly recommend seeing a lawyer as soon as possible after a workplace injury to protect your rights and make sure all deadlines are met.

Having a pre-existing medical condition does not automatically stop you from making a successful workers compensation claim. Under WA law, if your job significantly contributed to your injury, made your pre-existing condition worse, or sped up the decline of a pre-existing condition, you may still be entitled to compensation. The key question is whether your work was a substantial contributing factor to your current condition or disability. Medical evidence is essential in these cases to show the link between your employment and your current symptoms. Our experienced solicitors at Soul Legal regularly handle claims involving pre-existing conditions and can assess whether your situation qualifies for compensation under the Workers’ Compensation and Injury Management Act.

To make a workers compensation claim in Baldivis or anywhere in Western Australia, start by reporting all your injuries to your doctor as soon as possible after the incident or after you realise your condition is work related. Get a medical certificate and make sure your doctor records the connection between your condition and your job. Fill out a workers compensation claim form and give it to your employer, who will pass it on to their insurer. The next important step is getting legal advice from specialist workers compensation solicitors. At Soul Legal’s Baldivis office, we can review your claim, make sure all required paperwork is complete and properly prepared, deal with the insurer on your behalf, and pursue all the entitlements available to you under the law.
